The Privacy Act 2020

What your website needs to get right, in plain language

New Zealand's Privacy Act 2020 is built around information privacy principles. Cookies and trackers that collect personal information fall under the same rules as any other collection.

  • Tell people what you collect

When you collect personal information from visitors, the Act expects you to tell them why and how it will be used. A clear cookie banner and privacy policy do that job on your website.

  • Be open about data from other sources

A newer principle, 3A, started on 1 May 2026. It covers telling people when you get their information from somewhere other than them, which can include tools and trackers on your site.

  • Keep it safe and be able to show your work

The Act also covers storing information securely and using it only for the purposes you gave. Consent records give you something concrete to point to if someone asks.

Does New Zealand law require a cookie banner?

New Zealand has no cookie-specific law. The Privacy Act 2020 applies when cookies or trackers collect personal information, and it expects you to be open about what you collect and why. A banner with a clear privacy policy is a practical way to do that.

Does Savira work for a New Zealand business?

Yes, for the website side of privacy: cookie banners, consent records and privacy policies.

Does the Privacy Act 2020 apply to an Australian business?

It can, if you do business in New Zealand, even without an office there. Whether it applies to you depends on your circumstances, so ask a New Zealand privacy adviser.

Will Savira make my site compliant?

Savira handles the website side: your banner, your records and your policy. Privacy also covers how you handle information outside your website, which Savira does not cover. It is not legal advice.
